These Terms and Conditions ("Terms") govern your access to and use of this website and the purchase of products from FORGEBRIX ("FORGEBRIX", "Company", "we", "us", or "our").

By accessing this website, placing an order, or otherwise using our services, you agree to be bound by these Terms. If you do not agree, do not use this website or place an order.

These Terms apply to the maximum extent permitted by applicable law. Nothing in these Terms limits, excludes, or affects any mandatory rights or remedies that cannot legally be limited or excluded under the law applicable to you.

2. ELIGIBILITY AND CUSTOMER RESPONSIBILITY
You may place orders only if you have legal capacity to enter into binding contracts under the law applicable to you.
You are responsible for ensuring that all information you provide is true, accurate, current, and complete.
You are solely responsible for ensuring that the purchase, importation, possession, and use of the products are lawful in your destination country, state, province, or territory.

We may refuse service, restrict access, cancel accounts, or reject orders where reasonably necessary to protect our business, customers, payment systems, intellectual property, legal compliance, or operational security.

3. TERRITORY AND ORDER RESTRICTIONS
We sell and ship to selected destinations worldwide, subject to shipping availability, legal restrictions, customs requirements, product restrictions, carrier limitations, sanctions compliance, fraud screening, and operational feasibility.

We reserve the right, at any time and in our sole discretion, to reject, cancel, limit, hold, or refuse any order, including where:
(a) the destination is unsupported or high-risk;
(b) the order appears fraudulent, abusive, or commercially unreasonable;
(c) there are customs, sanctions, export/import, safety, or legal concerns;
(d) the product is unavailable or mispriced; or
(e) fulfillment would expose us to unreasonable cost, risk, or liability.

4. PRODUCT INFORMATION AND VARIATIONS
We make reasonable efforts to describe and display products accurately. However, all product descriptions, images, videos, renderings, colors, finishes, dimensions, weights, and specifications are approximate and for general informational purposes only unless expressly stated otherwise.

Minor variations, including variations in color, texture, surface finish, dimensions, packaging, engraving, handcrafted appearance, or batch differences, do not constitute a defect, non-conformity, or misdescription.

Products sold on a handcrafted, made-to-order, batch-production, pre-order, or limited-run basis may vary slightly from photographs, mockups, samples, prototypes, or prior units.

5. PRE-ORDERS, MADE-TO-ORDER, AND CUSTOMIZED PRODUCTS
Certain products may be sold on a pre-order, made-to-order, small-batch, or customized basis. If a product listing states or implies this, you acknowledge and agree that:
(a) production or allocation may begin only after order acceptance;
(b) orders may be fulfilled in batches or production runs;
(c) estimated production or fulfillment windows are estimates only;
(d) stated fulfillment times refer to the period before dispatch unless expressly stated otherwise.

Where a product is personalized, custom-made, engraved, modified to your specifications, or otherwise clearly tailored to your individual request, any cancellation, withdrawal, exchange, or return rights may be excluded or limited to the maximum extent permitted by applicable law.

Where a product is merely manufactured on demand but not personalized or individually specified, any mandatory consumer cancellation or withdrawal rights that apply under your local law remain unaffected.

6. PRICES, CURRENCY, TAXES, DUTIES, AND FEES
All prices are displayed in the currency shown on the website or at checkout. Prices may be changed at any time before order acceptance.

Unless expressly stated otherwise, prices do not include shipping, insurance, customs duties, import charges, tariffs, VAT, GST, sales tax, brokerage fees, clearance charges, local levies, or similar charges.

For international orders, you are solely responsible for all import duties, taxes, customs charges, brokerage charges, handling fees, local taxes, and similar charges imposed by the destination country or carrier, unless we expressly agree otherwise in writing.

If we are legally required to collect VAT, sales tax, GST, or similar taxes, those amounts may be added at checkout.

7. ORDER PLACEMENT AND ACCEPTANCE
Your order is an offer to purchase. We are not obliged to accept any order.
A contract is formed only when we expressly accept your order by confirmation email, dispatch confirmation, or other clear written acceptance.

We may reject, cancel, or limit any order before or after payment for legitimate reasons, including pricing errors, stock issues, product restrictions, fraud screening, customs/import issues, legal compliance concerns, technical errors, or shipping limitations.

If we cancel an order after payment has been received, our sole obligation shall be to refund the amount actually paid for the cancelled item or order, unless applicable law requires otherwise.

8. PAYMENT
Payment must be made using one of the payment methods offered at checkout.
By submitting payment information, you represent and warrant that:
(a) you are authorized to use the selected payment method;
(b) all payment information provided is accurate; and
(c) the charge will not be wrongfully disputed or reversed.

We may suspend or cancel an order where payment is declined, reversed, flagged as suspicious, or creates unreasonable fraud or chargeback risk.

9. TITLE, RISK, SHIPPING, AND DELIVERY
Title to the goods remains with us until full payment has been received, to the extent permitted by applicable law.

Risk of loss or damage passes in accordance with applicable mandatory law. Where no mandatory law requires otherwise, risk passes upon delivery of the goods to the delivery address provided by you.

Delivery dates and shipping times are estimates only and are not guaranteed unless we expressly state otherwise in writing.
We are not liable for delay, non-delivery, or additional costs caused by:
(a) customs processing;
(b) carrier disruptions;
(c) weather events;
(d) peak demand;
(e) incorrect or incomplete address information;
(f) refusal of delivery;
(g) failure to collect the parcel;
(h) force majeure; or
(i) events outside our reasonable control,
except where liability cannot be excluded under applicable law.

10. SHIPPING DELAYS AND UNFULFILLED ORDERS
Any stated shipping, production, dispatch, or delivery timeframe is an estimate unless expressly stated otherwise.
If we are unable to dispatch within a stated timeframe, we may notify you and, where required by applicable law, offer you the option to wait or cancel the unshipped order for a refund.

We reserve the right to make partial shipments where reasonable.

11. CUSTOMER CANCELLATIONS
Because many of our products are made to order, produced in batches, reserved for your order, or otherwise prepared specifically for fulfillment, customer cancellation requests are generally not accepted once production, reservation, allocation, packaging, or dispatch preparation has begun.

Any cancellation request made before production or allocation begins is entirely at our discretion unless mandatory law provides otherwise.

Where mandatory consumer cancellation or withdrawal rights apply, those rights remain unaffected and are governed by the separate Withdrawal / Cancellation Notice and Refund Policy, which form part of these Terms.

12. RETURNS, REFUNDS, REPLACEMENTS, AND CLAIMS
Except where required by applicable law, all sales are final.
We do not offer voluntary returns, refunds, or exchanges for:
(a) change of mind;
(b) buyer's remorse;
(c) incorrect selection by the customer;
(d) minor variations consistent with handcrafted, batch, or made-to-order production;
(e) delays caused by customs, local delivery services, import controls, or carriers after dispatch;
(f) refusal to pay customs duties, taxes, or import charges;
(g) parcels refused, abandoned, or left uncollected by the customer.

Returns will not be accepted without our prior written authorization and return instructions.
Unauthorized, refused, freight collect, or cash-on-delivery returns may be rejected.

Where a return or remedy is legally required or expressly approved by us, we may request reasonable evidence, including photographs, videos, order information, packaging details, and a description of the issue.

Customers should inspect deliveries promptly and contact us as soon as reasonably possible after discovering any damage, defect, wrong item, or material non-conformity, and preferably within 7 days of delivery. This request is intended to allow prompt investigation and does not reduce any mandatory statutory rights that may apply.

If a claim is valid, and to the extent required by applicable law or approved by us, the remedy may be repair, replacement, re-shipment, refund, store credit, or another remedy we consider appropriate or that the law requires.

13. NON-RETURNABLE AND NON-REFUNDABLE ITEMS
To the maximum extent permitted by applicable law, the following are non-returnable and non-refundable:
(a) personalized, custom-made, engraved, bespoke, or individually configured products;
(b) products made to a customer's specific request;
(c) perishable goods;
(d) sealed goods that are not suitable for return for health protection or hygiene reasons once unsealed;
(e) gift cards, store credit, and promotional items;
(f) digital content, downloadable files, software keys, and other instantly delivered digital items once access, download, activation, or delivery has begun;
(g) final-sale items where permitted by applicable law.

14. RETURN COSTS, ORIGINAL SHIPPING, AND DEDUCTIONS
Where a return is permitted or required, the customer bears the direct cost of return shipping unless applicable law requires otherwise or we expressly agree otherwise in writing.

Original shipping charges, insurance charges, customs charges, duties, taxes, brokerage fees, and similar charges are non-refundable except where applicable law requires otherwise.

If a parcel is returned to us because the customer provided an incorrect address, failed to collect the shipment, refused delivery, or refused to pay import-related charges, we may deduct our direct shipping, return shipping, storage, customs, payment processing, handling, and other direct costs from any refund, to the maximum extent permitted by law.

Where applicable law allows us to withhold a refund until goods are returned or proof of return is received, we may do so.

15. PRODUCT USE, SAFETY, AND ASSUMPTION OF RESPONSIBILITY
You must use all products only for their intended and lawful purpose and in accordance with any safety instructions, warnings, product descriptions, and care guidance we provide.

You must not misuse, alter, modify, test, disassemble, or use any product in a manner that is dangerous, unlawful, reckless, abusive, or inconsistent with its intended purpose.

You assume full responsibility for ensuring that the product is suitable, lawful, and safe for your intended use and jurisdiction, except to the extent prohibited by applicable law.

Where a product page includes a specific safety notice, age recommendation, novelty-use statement, replica statement, or handling warning, that notice is incorporated into these Terms.

16. INTELLECTUAL PROPERTY
All content on this website, including text, graphics, logos, icons, images, videos, product names, product designs, descriptions, layouts, trademarks, trade dress, and software, is owned by us or our licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, publish, display, adapt, scrape, reverse engineer, exploit, or use any content or product design without our prior written consent.

17. USER CONDUCT
You agree not to:
(a) use the website or products for any unlawful, fraudulent, abusive, or harmful purpose;
(b) interfere with website security, integrity, or operation;
(c) submit false or misleading information;
(d) impersonate another person;
(e) use bots, scraping tools, or automated methods without authorization;
(f) infringe our intellectual property or the rights of others;
(g) upload or transmit harmful code, spam, or malicious content.

18. REVIEWS, SUBMISSIONS, AND USER CONTENT
If you submit reviews, images, comments, suggestions, ideas, testimonials, or other content, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable license to use, reproduce, adapt, publish, display, distribute, and exploit such content in connection with our business, subject to applicable law.

You represent that your content is lawful, accurate, non-infringing, and does not violate any third-party rights.
We may remove or refuse any user content at our discretion.

19. CHARGEBACKS AND PAYMENT DISPUTES
You agree to contact us first to attempt to resolve any issue before initiating a chargeback or payment dispute.

Where a chargeback, reversal, or payment dispute is initiated without valid legal basis, we reserve the right to contest it and submit relevant order records, communication records, tracking records, proof of delivery, usage records, fraud-screening data, and other evidence to the payment processor, platform, card network, or dispute body.

20. DISCLAIMER
To the maximum extent permitted by applicable law, this website and all products and services are provided on an "as is" and "as available" basis, without any representations, warranties, or guarantees except those that cannot legally be excluded.

We do not warrant that the website will be uninterrupted, secure, error-free, or free of harmful components, or that all product listings, descriptions, images, or specifications will always be complete, current, or error-free.

21. LIMITATION OF LIABILITY
To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, consequential, exemplary, punitive, or special damages, including loss of profits, loss of revenue, loss of savings, loss of business, loss of goodwill, loss of opportunity, or loss of data.

To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to any order, product, service, website use, or claim shall not exceed the amount actually paid by you for the product or order giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited, including liability for fraud, fraudulent misrepresentation, willful misconduct, or, where the applicable law so provides, death or personal injury caused by negligence.

22. INDEMNITY
To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless FORGEBRIX, its affiliates, directors, officers, employees, agents, contractors, and service providers from and against claims, losses, liabilities, damages, costs, and expenses arising out of:
(a) your misuse of the website or products;
(b) your breach of these Terms;
(c) your violation of any law or third-party right; or
(d) your content, submissions, or unlawful conduct.

23. FORCE MAJEURE
We are not liable for any delay, interruption, or failure to perform resulting from events beyond our reasonable control, including natural disasters, war, terrorism, civil unrest, labor disputes, epidemics, pandemics, supply shortages, material shortages, customs delays, transport disruptions, cyber incidents, governmental actions, sanctions, utility outages, or carrier failures.

24. GOVERNING LAW AND JURISDICTION
These Terms and any dispute arising out of or in connection with them shall be governed by the laws of Germany, excluding its conflict-of-laws rules and excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent permitted by applicable law.

If you are acting for purposes related to your trade, business, or profession, the exclusive place of jurisdiction for all disputes shall be Ludwigshafen am Rhein, Germany.

If you are a consumer, this governing law clause applies only to the extent that it does not deprive you of mandatory protections granted by the law of your country of habitual residence.

If you are a consumer, any jurisdiction clause in these Terms applies only to the extent permitted by applicable law. Where mandatory law grants you the right to bring proceedings in another court, that right remains unaffected.

25. SEVERABILITY
If any provision of these Terms is found to be unlawful, invalid, unfair, or unenforceable, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect.

26. NO WAIVER
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

27. ASSIGNMENT
You may not assign, transfer, or dispose of any rights or obligations under these Terms without our prior written consent.
We may assign, transfer, subcontract, or delegate our rights and obligations under these Terms to any affiliate or successor, to the extent permitted by law.

28. PRIVACY AND RELATED POLICIES
Your use of the website and purchase of products are also subject to our Privacy Policy, Refund Policy, Shipping Policy, and, where applicable, our Withdrawal / Cancellation Notice. Those policies are incorporated into these Terms by reference.

29. CHANGES TO THESE TERMS
We may update these Terms from time to time by posting a revised version on this website.
The version in effect at the time of your order will generally apply to that order unless applicable law requires otherwise.
